LITTLETON ZONING BOARD OF ADJUSTMENT

TUESDAY, AUGUST 9, 2016

PRESENT: Chairman Eddy Moore, Guy Harriman Jessica Daine, Jerry LeSage, David Rochefort, and Joanna Ray (recording secretary)

EXCUSED: Vice Chair Art Tighe

OTHERS: Rod Trahan, Donna Trahan, and Mike Norman

 

Chairman Moore called the meeting to order at 6:00.  Guy Harriman was designated a voting member for this meeting.  Jessica stated she might have a conflict of interest.  Chairman Moore replied that he didn’t feel there was a conflict.  There will be five voting members for the case.

 

Review of minutes from June 28, 2016.  Jerry made a motion to approve the minutes as written.  Jessica second the motion.  The motion passed 5-0.

 

Rodney & Donna Trahan, Owners – ZBA16-08 – Request for a Variance relating to Article V, Section 5.01 of the Littleton Zoning Ordinance to allow an accessory structure with less than the required 25’ side and rear setbacks at 165 Union Street, tax map 79-60, in the C-I zone.

 

The case was noticed in the Caledonian-Record, abutters were notified, and the case fees were paid.  Chairman Moore accepted the case as complete.  Rod Trahan explained that the apartment building on the lot is number 165 and the barn that was removed over a year ago was considered number 167.  Chairman Moore stated the hearing notice was complete because number 165 explains the location of the request. 

 

Mike Norman presented the request.  The proposed structure will replace what was removed over a year ago.  The previous structure was in very bad condition.  The proposed structure will be either 30’ X 80’ or 40’ X 80’.  Regardless of the building dimensions, the building will have a side setback of 6’ and a rear setback of 15’.  The building will be near the location of the previous.  The rear of the building will act as a retaining wall.  There will be a minimum of 15’ between the new building and the apartment building. 

 

The proposed building will be storage for Arrow Equipment which is on the abutting lot.  Trahan owns both of the lots.  They have a growing business and need room for storage.  The building will also serve as indoor parking for the business vehicles.  There will not be any manufacturing in the building.

 

Jessica read the submitted findings of the facts.  David noted that if the variance is not allowed, the Trahan’s will have to move their storage to a different location and that would be a burden. Chairman Moore stated that the non-conforming setbacks are consistent for the neighborhood.  There were no abutters present to voice any concerns.  Rod Trahan informed the Board that Trevor Presby, abutter, told him that he did not have any problems with the proposal.  Jessica noted that there is no other location on this lot for the structure.  The Board agreed with the findings of the facts.  The public input was closed.

 

Jerry LeSage made a motion, based on the submitted information and testimony, to approve Rodney & Donna Trahan, Owners – ZBA16-08 – Request for a Variance relating to Article V, Section 5.01 of the Littleton Zoning Ordinance to allow an accessory structure with a 6-foot side setback and 15-foot rear setback at 165 Union Street, tax map 79-60, in the C-I zone with the condition that the applicant complies with all Federal, State, and Local regulations.  Guy Harriman second the motion. The motion passed 5-0.  The applicant was informed of the 30-day appeal period. 

 

At 6:40, Jessica made a motion to adjourn.  Jerry second the motion.  The motion passed 5-0.
