Draft Zoning Board Minutes October 11, 2016





6:00 PM




PRESENT:  Chairman Eddy Moore, Vice Chair Art Tighe, Jessica Daine, Jerry LeSage, David Rochefort, and Joanna Ray (recording secretary)


EXCUSED: Guy Harriman

Chairman Moore called the meeting to order and announced that there were 5 voting members present.


CONTINUATION OF:  Steven Kelley, Owner/Applicant – ZBA16-09 – Request for a Special Exception relating to Article IV, Section 4.02.05 of the Littleton Zoning Ordinance to allow warehouse storage and a parking lotat 212 Union St, tax map 79-182, in the C-I zone.


Art addressed the question of whether or not the storage containers would fall under the warehouse definition.  All board members agreed with the attorney’s opinion that these containers do not fall under the definition of warehouse. Because of this agreement, it was determined that the board had nothing to act on.  


Art addressed the question of whether or not approval is required for NAPA employees to park on this lot.  No board member disagreed with Art’s statement that the average of four cars parking daily on the lot would cause no nuisance and it is common in the Commercial zone.  Because of this agreement, it was determined that the board had nothing to act on.


Art mentioned an additional anonymous letter that the Town received regarding this hearing.  The board is not required to read it. A copy will be kept in the case file.


Steve explained to the board that Chief Smith informed him that the sides of Union Street are not designated for parking.  This is the reason Steve has offered the other property for his employees to park. 


Steve asked the board if there was anything else he needed to do or if he should withdraw his application.  Chairman Moore explained that it was determined that the application is not needed and that he may withdraw the request.  Steve confirmed he was withdrawing his request.  Art stated that no more action is needed.  There is nothing in the ordinance that matches this request.  The attorney informed the board that shipping containers are not structures per the Zoning Ordinance.

Jerry made a motion to approve the minutes as written.  Art second the motion.  The motion passed 5-0.


At 6:15, Art made a motion to adjourn.  Jessica second the motion.  The motion passed 5-0.
