LITTLETON ZONING BOARD OF ADJUSTMENT

TUESDAY, SEPTEMBER 27, 2016

LITTLETON COMMUNITY HOUSE

APPROVED MINUTES

 

 

PRESENT:  Chairman Eddy Moore, Vice Chair Art Tighe, Jerry LeSage, Guy Harriman, David Rochefort, Jessica Daine, and Joanna Ray (recording secretary)

OTHERS: Amy Nadeau & Rooks Turner

 

Chairman Moore called the meeting to order at 6:00.  A full board was present with no conflicts noted. 

 

Amy Nadeau & Rooks Turner, Applicants – ZBA16-10 – Request for a Special Exception relating to Article VI, Section 6.12 of the Littleton Zoning Ordinance to allow the raising of chickens at 120 Kimball Street, tax map 95-14, in the R-I zone.  Chairman Moore reviewed the application and accepted it as complete. 

 

Amy Nadeau explained that her property is almost 8 acres and the neighbor also has chickens.  The chickens will help reduce bugs on the property.  Amy stated she would have around 20 chickens and maybe a rooster.  There are not structures yet.  The applicants were waiting until they received this approval before applying for the building permit.  Art reviewed the requirements for the property setbacks in regards to the structure and animal waste.  Amy confirmed everything will be away from the property lines.  The neighbors will not be impacted.  There was no one present wishing to comment.

 

Art read the submitted information.  The site is appropriate because the chickens will be near the garden and away from the road.  Property values will not be reduced because there will be a small cute shed providing quality eggs.  There will be reduced tick, insect, and snail populations which means less insecticide.  This will be a well maintained flock and will not be noticed.  The chickens will have proper housing and fencing. 

 

The public input portion was closed. Jessica stated there is plenty of land for this use.  David stated the use is consistent with the neighbor.  Jessica agreed there is a like use in the area.  David stated this is a secluded area and the chickens would not be visible.  Jessica stated the shelter and fencing will insure proper care. The board agreed with the findings of the facts. 

 

Jessica Daine made a motion to approve Amy Nadeau & Rooks Turner, Applicants – ZBA16-10 – Request for a Special Exception relating to Article VI, Section 6.12 of the Littleton Zoning Ordinance to allow the raising of chickens at 120 Kimball Street, tax map 95-14, in the R-I zone with the condition that the applicants comply with all Federal, State, and Local regulations.  Jerry LeSage second the motion.  The motion passed 5-0.  Chairman Moore informed the applicants that a building permit will not be issued until the end of the 30-day appeal period. 

 

The board received an anonymous letter regarding Steve Kelley’s hearing that was continued until October 11th.  Board members voiced concerns on whether or not to read the letter.  There was no proof that it was actually written by a Littleton resident.  Art suggested that the board accept the letter as received, but not to read it into the record.  The board directed Joanna to find out if the board is required to read a letter that has not been signed. 

 

The next meeting will be the continuation of ZBA16-09 on October 11, 2016 at 6:00 PM.  Art recommended that each board member read the legal opinion they received and be prepared for the continuation hearing.

 

Review August 23, 2016 minutes Jerry made a motion to approve the minutes as written.  Art second the motion.  The motion passed 5-0.

 

At 6:30, Art made a motion to adjourn.  Jerry second the motion.  The motion passed 5-0.
