ARTICLE XII. ADMINISTRATION - ZONING OFFICER 12.01 Zoning Officer The Board of Selectmen shall appoint and replace, if necessary, a Zoning Officer whose duty it shall be to administer the provisions of this ordinance. 12.02 Procedure Any person desirous of undertaking any activity to which the provisions of this ordinance apply shall first submit to the Zoning Officer: 1. A complete application for a Building Permit; 2. A drawing indicating location and extent of the intended use of the land; 3. Deleted at Town Meeting on March 13, 1990.
The Zoning Officer shall then grant or deny the application within a 30-day period. An extension of this review period shall be granted upon notification of the applicant and special circumstances, which warrant additional review time. If the application is approved, the Zoning Officer shall give the applicant a building permit. Such permit will become null and void if the proposed undertaking is not commenced within one year. The Zoning Officer shall inspect the undertaking from time to time to insure that the provisions of this ordinance are met. If at any point during the undertaking the Zoning Officer finds that the work does not meet with the provisions of the ordinance, he shall so inform the applicant and may withdraw the building permit and order that work be stopped.
12.03 Appeals In cases where a permit has been denied or revoked, the applicant may appeal to the Board of Adjustment who shall have the power to: 1. Hear and decide appeals, if it is alleged there is error in any order, requirement, decision, or determination made by an administrative official in the enforcement of any zoning ordinance adopted pursuant to RSA 674:16; and
2. In exercising its power under paragraph 1, the Zoning Board of Adjustment may reverse or affirm, wholly or in part, or may modify the order, requirement, decision, or determination appealed from and may make such order, or decision, as ought to be made and to that end, shall have all the powers of the administrative official from whom the appeal is taken.
