APPROVED MINUTES

Present: Chairman Eddy Moore (via speakerphone), Art Tighe, Jessica Daine, Jerry LeSage, Guy Harriman, and Joanna Ray (recording secretary)

Excused: Vice Chair Sean Sweeney and Heidi Hurley

Others: Joe Tavernier and Darin Wipperman (The Courier)

Chairman Moore called the meeting to order at 6:15 PM. Jerry LeSage and Guy Harriman were designated as voters for this meeting. There will be five voting members. Chairman Moore accepted the application as complete. There were no conflicts noted.

Tanis J. Tavernier Jr., Owner & Applicant – ZBA15-07 – Request for a Special Exception relating to Article IV, Section 4.02.04 of the Littleton Zoning Ordinance to allow an Auto Sales Agency at 1445 Mount Eustis Rd, tax map 102-1, in the Rural zone.

Joe Tavernier explained that he received a Special Exception in 2012 for an auto repair garage. There are currently 3 full-time and 1 part-time employees. This is a small local family business. The building is 35’ X 75’ with 4 bays, 2 bathrooms, and a waiting area. Only using 1.25 of the 4.41 acres. There are 15 parking spaces in the front and 4 on the side with additional parking area in the rear.

Art Tighe asked how many cars he would like to be selling at one time. Joe Tavernier replied it would be a maximum of 10 autos for sale. Joe also stated that there will still be about 3 acres not being disturbed.

Art Tighe asked what the hardship would be if the Board did not approve the request. Joe Tavernier responded that it would affect his business. After a brief discussion, Chairman Moore clarified that the request was for a Special Exception and not a Variance. Proving hardship is not part of the Special Exception process.

There were no abutters present for input. Art Tighe read through the findings of the facts submitted by the applicant:

  • The specific site is an appropriate location for such a use because auto sales agency is allowed by special exception under section 4.02.04 rural zone as described on page 33 of the town zoning ordinance.
  • Property values will not be reduced because property is being utilized as an automotive repair garage and looking for a special exception to sell used motor vehicles.
  • No nuisance or unreasonable hazard will result with this request.
  • Adequate and appropriate facilities will be provided for the proper operation and maintenance of the proposed use because vehicles for sale will be stored in front parking lot and repair vehicles will utilize rear lot.

There were no other comments. The public input was closed.

Jessica Daine made a motion to approve Tanis J. Tavernier Jr., Owner & Applicant – ZBA15-07 – Request for a Special Exception relating to Article IV, Section 4.02.04 of the Littleton Zoning Ordinance to allow an Auto Sales Agency at 1445 Mount Eustis Rd, tax map 102-1, in the Rural zone with the following conditions:

  • The applicant is allowed up to 10 cars for sale at a time
  • The applicant must comply with all Federal, State, and Local regulations

Jerry LeSage seconded the motion. The motion passed 5-0.

The applicant was informed of the 30-day appeal period.

REVIEW OF MINUTES:
June 23, 2015 – Art Tighe made a motion to approve the minutes as written. Jerry LeSage seconded the motion. The motion passed 5-0.

At 6:35, Art Tighe made a motion to adjourn. Jerry LeSage seconded the motion. The motion passed 5-0.
